Terms of service

Clear terms for careful firing.

These terms govern monsoonfire.com, the Firing Pathfinder, and firing services provided by Monsoon Fire Pottery Studio. A firing ticket is a request and planning record; it is not a guaranteed booking or final quote.

1. Agreement and related documents

By using the website, you agree to these Terms. By sending a Firing Pathfinder request, you also acknowledge the current Studio Policies. Our Privacy Policy explains how information is handled. If a specific written quote or service agreement conflicts with these general Terms, the more specific written agreement controls for that service.

2. What the website and Pathfinder do

The website provides information and planning tools. Pathfinder estimates are informational and may change after staff inspects the work, confirms materials, and determines actual kiln space. A submitted ticket means the studio expects a handoff; it does not guarantee acceptance, firing date, result, or final price.

Monsoon Fire may decline, pause, or require additional information for work that is unsafe, incompatible, unusually large, unknown, mislabeled, or outside current capacity.

3. Eligibility and authority

You must be at least 18, or use the service with a parent or legal guardian who accepts these Terms. You represent that you own the work or have authority to submit it and make decisions about firing, payment, pickup, and remedies.

4. Your materials and safety duties

  • Accurately disclose clay body, firing range, glaze, repairs, metal, glass, organic material, inclusions, unknown materials, and prior firings.
  • Provide work that is dry, stable, safe to transport, and clean where it meets the kiln shelf.
  • Package and transport work safely and follow the private access instructions in the studio email.
  • Do not submit hazardous, explosive, contaminated, stolen, or unlawfully possessed material.

Studio staff controls kiln loading, placement, compatibility, firing schedule, and whether work can be fired. Misidentified or undisclosed materials may damage your work, other work, shelves, or equipment. You may be responsible for reasonably documented damage caused by your breach of these duties, subject to applicable law.

5. Estimates, final charges, and payment

Website and Pathfinder prices are estimates, not bills. The final charge is based on the work actually accepted and the kiln space and service actually used. Monsoon Fire generally issues a final Stripe invoice after firing. Payment-card details are handled by Stripe, not the Pathfinder.

You may ask about a charge before paying. Undisputed amounts remain due by the invoice date. Nothing in these Terms removes consumer rights that cannot lawfully be waived.

6. Cancellation, refunds, and holds

If you cancel before firing begins, there is no firing charge. Once firing begins, a normal firing or maker/material-related outcome remains billable. If the studio determines that its own error caused the failure, there is no firing charge; if already paid, the affected firing charge will be refunded in full or in a documented proportion when only part of the service was affected.

A disputed charge may be placed on hold while the studio reviews kiln records, photographs, material disclosures, and the affected work. See the Payments and refunds policy.

7. Ceramic and kiln risk

Ceramics involve inherent, sometimes unavoidable risks including cracking, warping, glaze movement, bloating, color variation, thermal shock, material reactions, and interaction with neighboring pieces. A normal firing cannot guarantee an artistic or commercial result.

Responsibility is determined from the cause and available evidence. Studio fault is handled under the refund policy; maker, material, construction, or ordinary kiln-variation outcomes remain the maker’s risk. These Terms do not exclude or limit liability where Arizona law does not allow it, including responsibility for fraud, willful misconduct, or other non-waivable conduct.

8. Pickup, storage, and unclaimed work

Wait for the ready email before pickup and collect work promptly. Current notices, grace periods, and any storage charges are stated in the Studio Policies.

No automatic ownership transfer.

Missing a pickup date does not, by itself, transfer ownership to Monsoon Fire. The studio will use reasonable contact attempts and any notice and disposition process required by applicable law. Unclaimed work remains on hold unless and until a lawful, documented process permits another disposition.

9. Photos, feedback, and website content

Monsoon Fire may photograph work when reasonably needed for intake, kiln loading, incident review, safety, billing, or dispute documentation. Public marketing use requires a separate permission unless the image does not identify you or your work. You retain ownership of your artwork.

Website text, graphics, and branding belong to Monsoon Fire or their licensors and may not be copied for commercial use without permission. You may download or print legal and service documents for your own records.

10. Arizona law and disputes

These Terms are governed by Arizona law, without applying rules that would select another jurisdiction. Before filing a claim, please email support@monsoonfire.com with the ticket or invoice reference and requested resolution so both sides can try to resolve it informally. This informal step does not shorten a legal deadline or prevent either side from seeking urgent relief.

There is no mandatory arbitration clause or class-action waiver in these Terms.

11. Changes, severability, and contact

We may update these Terms prospectively. The date and version at the top identify the terms presented with a request. If one provision is unenforceable, the remaining provisions continue to the extent permitted by law. A delay in enforcing a term is not a permanent waiver.
